BOOKING TERMS AND CONDITIONS
These Booking Terms and Conditions apply when you book a trip with Soba Ceylon Reisen Pvt Ltd, registered in Sri Lanka at No.18, Haliyadda, Danture, 20465, Sri Lanka. (registered company number PV00269944) (‘Soba Ceylon’, ‘Company’, ‘we’, ‘us’, or ‘our’). By booking a trip with us, you agree to abide by these Booking Terms and Conditions, including any special conditions that apply to your trip, forming the entire agreement between you and us.
By booking with Soba Ceylon, you enter a legally binding agreement governed by these Booking Terms and Conditions and any applicable special conditions. This agreement constitutes the entire contract between you and our company. Review and understand these terms as they outline the rights, responsibilities, and obligations of both parties during your travel. Proceeding with booking acknowledges your acceptance of these terms as the basis of our contractual partnership. Any deviations must be explicitly agreed upon in writing.
Our Privacy Policy outlines our commitment to safeguarding clients’ personal information. Any data collected during booking will be handled carefully and per our Privacy Policy. By confirming your reservation, you consent to sharing this information with relevant parties solely for facilitating your tour. Per applicable laws, we may use your contact information for marketing our events and offers. Review our Privacy Policy regularly for updates on how we handle your personal information transparently and maintain your trust.
Price quotes are integral to our transparency and customer satisfaction. The booking confirmation invoice will outline the services you have reserved. Prices are per person in US Dollars, subject to availability at booking. We reserve the right to correct pricing errors until the deposit is paid. Upon receiving your request and deposit, we will process your confirmation within 10 business days for a smooth booking experience. This approach provides accurate pricing information, fostering trust in our services.
To secure your booking, a refundable deposit of US$100 is required. For bookings made within 60 days of the travel date, full payment is mandatory to confirm your reservation. No accommodation confirmations or arrangements will be processed until the payment is received. The final payment is due 45 days prior to the commencement of the tour.
Prices are valid for payment via credit card (Visa or Mastercard) or bank deposit. Credit card payments incur an additional 2-3% fee, or approximately US $25 for overseas bank transfers, in addition to the tour amount. Please note that you are responsible for any fees charged by your bank. Soba Ceylon is not liable for any shortfall in payment due to exchange rate fluctuations or bank fees. Final documents will only be issued upon receipt of full payment and cleared funds.
If you cancel part or all of your booking, the following cancellation terms apply:
We strongly recommend purchasing cancellation insurance at the time of booking. No refunds will be issued for unused services if you leave a trip after it has started, fail to join a trip, or join it after departure.
For all excursions, a full refund is available if cancelled 48 hours before the tour starts. A 100% cancellation fee applies if cancelled within 48 hours of the tour start time.
In case of circumstances beyond our control, Soba Ceylon reserves the right to modify or cancel any scheduled trip before its commencement. These include natural disasters, political unrest, terrorism, adverse weather, cultural considerations, or other events compromising traveler safety.
If a tour is canceled, you can transfer your payment to an alternative date or receive a full refund of the tour cost. However, refunds are not applicable for Force Majeure events (defined below).
Cancellation due to Force Majeure
In case of a Force Majeure Event leading to tour cancellation, we offer fair options. If cancelled before the tour starts, you can choose either a 100% credit of the amount paid or a refund minus any unrecoverable costs we incurred.
In the event of a Force Majeure cancellation after your tour has commenced, we will offer a pro-rata choice of either a 100% credit for the remaining tour days or a refund minus unrecoverable costs associated with those remaining days.
A “Force Majeure Event” encompasses, but is not limited to, acts of God, war, civil unrest, riots, blockades, embargoes, fires, explosions, breakdowns, labor disputes, earthquakes, epidemics, pandemics or other health emergencies, floods, severe weather events, supply chain disruptions, and any governmental actions or regulations beyond our reasonable control, which would render the commencement or continuation of your tour dangerous or unviable.
In the event of cancellation, neither party shall claim damages against the other, and we are not responsible for any incidental expenses incurred.
If a provider cancels an activity, service, or accommodation booking (e. g., due to weather), Soba Ceylon may refund you or offer an alternative. Refunds are processed after Soba Ceylon receives a refund from the provider. Refunds are returned to the original credit card or bank account, person(s), and proportions as the initial transaction.
Important Note regarding credit:
Our company may offer you a credit voucher in certain circumstances, such as when you’re eligible for a full or partial refund instead of a cash reimbursement. This credit voucher has no expiration date, can be used for any other available trip with our company, is non-transferable and non-refundable, and cannot be used for flights or insurance bookings. Please review these conditions for a smooth transaction process.
Booking amendments have specific terms and conditions.

Minimum Age: Tours are primarily for adults aged 18 and above, unless minors are explicitly authorized by Soba ceylon. Children are permitted when accompanied by a parent/guardian.
Maximum Age: There is no upper age limit, but reasonable physical fitness is required to participate. Individuals should seek medical advice beforehand to ensure their health condition aligns with the tour’s demands.
Soba Ceylon prioritize road safety by requiring mandatory breaks and strict driving time limits to prevent driver fatigue, a significant contributor to accidents. These measures promote alertness and concentration, with designated uninterrupted rest periods allowing drivers to fully recharge physically and mentally before resuming their journey. This commitment to responsible driving practices through well-rested and focused drivers aims to reduce fatigue-related accidents, protecting all road users.
Travel insurance is essential, providing comprehensive protection against unforeseen circumstances during your journey. Coverage should include personal accidents, medical emergencies, repatriation, and trip cancellations, mitigating potential losses. Providing detailed insurance information before travel is mandatory, fulfilling legal obligations and ensuring preparedness for any challenges, allowing you to embark with confidence and security.
You are responsible for ensuring you have valid travel documents and meet immigration requirements for Sri Lanka.
Obtaining the necessary visas, passports, and travel documents is crucial for a smooth travel experience to Sri Lanka. As an international traveler, you must research and comply with the immigration requirements set by Sri Lankan authorities. Failure to do so may result in denied entry, delays, or legal consequences.
To enter Sri Lanka, you need a valid passport with at least six months validity beyond your stay. Most foreign nationals require a visa, obtained through the Department of Immigration and Emigration or diplomatic missions abroad. Visa requirements vary based on the purpose and duration of your visit. Carefully review the specific visa requirements for your nationality and travel purpose, including any additional documentation like proof of accommodation, travel itinerary, or financial means. Familiarize yourself with customs regulations to avoid carrying prohibited or restricted items, which may lead to confiscation, fines, or legal issues. Thoroughly preparing and obtaining the necessary documents ensures compliance with Sri Lankan immigration laws and contributes to a seamless and enjoyable travel experience.

Our tours are conducted by experienced and knowledgeable tour guides whose primary responsibility is to ensure the smooth operation of the tour and prioritize the health and safety of all participants. By choosing to travel with Soba Ceylon, you acknowledge and agree to abide by the authority of our tour guides and activity suppliers, as their decisions regarding the operational requirements of the tour and safety measures are final.
Failure to comply with the tour guide’s instructions or engaging in any illegal activities during the tour will result in the immediate termination of your travel arrangements without any liability or refund from Soba Ceylon or our third-party partners. Such behavior includes, but is not limited to, acts that are abusive, dangerous, or causing distress or material annoyance to others, as determined by the sole discretion of the Tour manager. In such cases, you will be responsible for any additional costs incurred, including return travel, accommodations, meals, and incidentals, and Soba Ceylon reserves the right to deny your participation in future tours.
Furthermore, it is your responsibility to comply with all applicable laws, customs, foreign exchange regulations, and drug regulations of Sri Lanka throughout the duration of the tour. Tour guests and group leaders are liable for any costs incurred by Soba Ceylon or our suppliers resulting from damage, destruction, theft, or excessive cleaning fees related to their accommodation, transportation, or other use of facilities during the tour.
Engaging in travel activities inherently carries certain risks that cannot be entirely mitigated. By undertaking a journey, you acknowledge and accept the potential hazards associated with travel, including but not limited to transportation accidents, exposure to unfamiliar environments, adverse weather conditions, and unforeseen circumstances beyond our control. As a responsible traveler, you agree to adhere to all safety protocols and guidelines provided by relevant authorities, tour operators, and local experts. This includes following instructions, exercising prudence and caution, and taking necessary precautions to minimize risks to yourself and others. While every effort will be made to ensure a safe and enjoyable experience, you understand that some level of risk is unavoidable when exploring new destinations. By proceeding with your travel plans, you affirm your willingness to assume these risks and take responsibility for your own actions and well-being throughout the duration of your journey.
To the maximum extent allowed by law, we are not liable for any loss or damage, including death or personal injury, resulting from any act or omission by us in connection with the Services or these Booking Terms and Conditions, unless caused by our fraud or willful misconduct.
If the law requires a warranty in these Booking Terms and Conditions that cannot be excluded, our liability will be limited to either providing the Services again or paying for the cost of having the Services provided again.
You agree to protect us (including our subsidiaries, officers, employees, contractors, and agents) from any losses, claims, actions, damages, costs, and expenses (including legal fees) that arise from:
This does not apply to losses or damages directly caused by our fraud or intentional misconduct.
We work with various companies, providers, independent contractors, and individuals (Third Party Suppliers) to run our tours. These suppliers may also hire local operators and subcontractors. While we strive to choose reputable suppliers, we are not responsible for their actions or omissions. Third Party Suppliers comply with the laws of the countries they operate in, and we do not guarantee their compliance with the laws of your country.
We are not liable for any actions or omissions of these Third Party Suppliers, whether negligent or otherwise. Any disputes with third parties must be resolved directly between you and the third party.
We are not liable for intentional or negligent acts of non-employees or our employees when off-duty or acting outside their employment scope.
Optional activities are not included in the contracted trip services. You are solely responsible for arrangements with third-party activity providers. By participating, you assume full risk and liability. Exercise caution when considering optional activities, as they fall outside the contracted services. The trip organizers and contracted parties have no liability for optional activities, which are undertaken at your own discretion and risk.
Tour guests or group leaders must report any tour-related grievances to Soba Ceylon promptly. This allows Soba Ceylon to address and resolve complaints effectively. Complaints should be reported to the Tour Manager or tour advisor immediately, as Soba Ceylon assumes no liability for complaints not brought to their attention in time for resolution. Any complaint after the tour must be received in writing by the tour advisor as soon as possible after the tour’s conclusion. Soba Ceylon will not entertain liability for claims received after the tour’s completion.
If any term or condition in these Booking Conditions is found to be unenforceable or void by law or public policy, it will be removed or adjusted, but only as much as necessary to keep the rest of the terms valid and binding. The invalidity or unenforceability of any specific provision does not affect the validity or enforceability of the remaining provisions, and the contract will be interpreted as if the invalid or unenforceable provision was never included.
These Legal Terms shall be governed by and construed in accordance with the laws of Sri Lanka. Soba Ceylon Reisen Pvt Ltd and you irrevocably consent that the courts of Sri Lanka shall have exclusive jurisdiction to settle any dispute which may arise in connection with these Legal Terms.
We adhere to Soba Ceylon’s Ethical Marketing Guidelines, reflecting our commitment to fostering an inclusive travel industry. We comply with the Advertising Standards Authority Code for responsible, ethical advertising. We may offer limited-time promotions with specific terms, which customers must read and understand. Promotions are subject to cancellation or modification at our discretion. Promotional terms take precedence over these Booking Conditions in case of inconsistencies for promotional bookings.

If your order involves recurring charges, you consent to our charging your payment method on a recurring basis without needing your prior approval for each charge until you cancel the order. We reserve the right to correct any pricing errors, even if payment has already been requested or received.
We may refuse any order placed through our services. We can also limit or cancel quantities purchased per person, per household, or per order at our discretion. These restrictions may apply to orders placed by or under the same customer account, using the same payment method, or sharing the same billing or shipping address. We may also limit or prohibit orders that, in our judgment, seem to be placed by dealers, resellers, or distributors.

Holding Period:
We will hold a non-confirmed reservation request as follows until we receive your final confirmation:
We reserve the right to cancel non-guaranteed reservations if no deposit is made, in order to accommodate confirmed bookings.
New Reservation Requests:
If a new reservation request is received, we may request the release of your held space. Alternatively, you must pay a 20% non-refundable deposit within 7 days to confirm your reservation.
Payment and Cancellation:
We reserve the right to cancel all services if full payment is not received 45 days prior to your arrival. For last-minute bookings, payment must reach us within 5 days of confirmation to avoid cancellation, with some services requiring full payment 24 hours before commencement, which is generally non-refundable.
Confirmation:
No reservation is confirmed until you receive written confirmation from us.
Flight Bookings:
For flight bookings, full payment for the ticket cost plus 20% of other service costs indicated on the invoice is required before we can issue tickets. Flight costs are subject to change until tickets are issued.
Amendments:
Any changes made after booking confirmation, such as travel dates, number of participants, or itinerary adjustments, are subject to our cancellation policy and may incur amendment fees.
Descriptions, Itineraries, and Activities:
Product and service descriptions are accurate at the time of publication but may change. We reserve the right to offer suitable alternatives if necessary due to factors like weather, operational changes, or seasonal conditions. Optional activities listed are subject to availability and seasonal factors; payment is made directly to the operator.
Pricing and Payments:
We may require fees or charges for our services. Payment terms are as follows:
Rates are typically per person per tour/night unless specified otherwise, and are subject to exchange rate fluctuations. We reserve the right to adjust prices due to factors beyond our control, such as taxes, fuel costs, or third-party charges.
Fuel Surcharge:
We may apply a fuel surcharge if crude oil prices escalate significantly.
Payment in Installments:
Installment payment plans may be arranged with prior written agreement from Soba Ceylon, specifying amounts, frequency, and due dates.
General Cancellation Terms: Due to the extensive planning involved in our tours, a strict cancellation policy is necessary to cover costs and lost opportunities. Once a booking is confirmed by us, the following cancellation fees will apply:
Excursions: For all excursions, a full refund is available if cancelled 48 hours before the tour starts. A 100% cancellation fee applies if cancelled within 48 hours of the tour start time.
No Show and Early Departure: If you fail to join a tour, join it after departure, or leave before its completion, no refund will be provided.
Additional Fees: Please note that accommodation providers, travel agents, or third-party tour operators may impose their own cancellation fees, which could vary from our policy. These fees are subject to change.
Behavioral Guidelines: Soba Ceylon reserves the right to refuse carriage to any person whose behavior disrupts the enjoyment of others. By traveling with us, you agree to respect the authority of our guides/tour leaders. They have the right to make decisions to ensure a safe and enjoyable experience for all passengers.
Safety and Conduct: Our staff deserves a safe working environment, and our passengers expect a pleasant holiday experience. Any threats, physical or verbal, or inappropriate behavior towards our staff or fellow travelers may result in immediate removal from the trip.
If a guide or property owner requires a passenger to leave due to unacceptable behavior, no refunds will be given, and the passenger will be responsible for their own travel arrangements from that point onward.
Travel Insurance: Soba Ceylon does not include travel insurance as part of its services. It is the sole responsibility of all guests to obtain comprehensive travel insurance covering personal effects, personal accident, medical expenses, emergency travel, cancellation, and curtailment.
Airline Services: If Soba Ceylon arranges airline services, quoted airfare and airport taxes are current but subject to change without prior notice due to airline rate adjustments. Fares are based on the lowest available class at booking. If unavailable, the next applicable fare will be booked, with any cost difference advised accordingly. Airlines may change schedules or discontinue routes, affecting connections. We will adjust your itinerary and costs accordingly.
Ticket Requirements: For compliance with international insurance standards, all airline tickets must display the passenger’s title, full name, and surname as per their passport. Please provide this information promptly for both scheduled and charter flights.
Check-in and Flight Times: Check revised check-in times for domestic and international flights. Guests must adhere to these times to avoid reservation cancellation. Please confirm these details before departure.
Visa and Passport Requirements: It is the guest’s responsibility to verify visa requirements well in advance of travel. Soba Ceylon cannot be held liable for any issues arising from incomplete visa requirements. Passports must be valid for at least 6 months after the travel date.
Medical Precautions: Guests are advised to take necessary medical precautions before traveling. Consult your pharmacist or travel clinic for recommendations. Guests must arrange their own medical insurance to cover emergencies.
Special Dietary Requirements: We accommodate special dietary needs. Please inform us of any requirements during reservation. Additional costs may apply for specific dietary requests. Please provide two weeks’ notice for special meal arrangements.
Gratuities: Tipping is discretionary but appreciated for excellent service. Guidelines can be provided by the hotel manager or tour guide.
Recommended Clothing: During tours, we recommend light cotton clothing. Long-sleeved attire is advised for religious sites. Pack warm clothing for hill country visits due to cooler temperatures.
Smoking Regulations: According to Sri Lankan Government regulations, smoking is prohibited inside tourist vehicles. Smoking is allowed only at designated stops.
You agree not to access or use the Services for any purpose other than as intended by Soba Ceylon Pvt Ltd. The Services may not be used for any commercial endeavors unless specifically endorsed or approved by us.
As a user of the Services, you agree:
The Services may offer features such as blogs, message boards, forums, and other interactive functionalities where you can create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials (“Contributions”). These Contributions may be visible to other users and through third-party websites. Therefore, any Contributions you make may be treated as non-confidential and non-proprietary.
When you create or share Contributions, you represent and warrant that:

When you post or make your Contributions accessible on the Services, including linking your account to social networking accounts, you automatically grant us an unrestricted, worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid license to use, copy, reproduce, disclose, sell, resell, publish, broadcast, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute your Contributions. This includes your image, voice, and any other content you provide, for any purpose, commercial, advertising, or otherwise. We may also create derivative works of, or incorporate your Contributions into other works, and grant sublicenses of these rights.
This license applies to any form, media, or technology now known or developed in the future. It includes our right to use your name, company name, franchise name, trademarks, service marks, trade names, logos, and personal and commercial images that you provide. You waive any moral rights in your Contributions, and confirm that no such rights have been asserted.
While we do not claim ownership of your Contributions, you retain full ownership and any intellectual property rights associated with them. Informal Negotiations
To expedite resolution and control the cost of any dispute, controversy, or claim related to these Legal Terms (each a “Dispute” and collectively, the “Disputes”) brought by either you or us (individually, a “Party” and collectively, the “Parties”), the Parties agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least thirty (30) days before initiating arbitration. Binding Arbitration
Any dispute arising out of or in connection with these Legal Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration administered in Colombo, Sri Lanka, pursuant to the Arbitration Act No. 11 of 1995 of Sri Lanka. The language of the arbitration shall be English, and the governing law shall be the substantive law of Sri Lanka.

The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the fullest extent permitted by law: (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilise class action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
Exceptions to Informal Negotiations and Arbitration
The Parties agree that the following Disputes are not subject to the above provisions concerning informal negotiations and binding arbitration: (a) any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a Party; (b) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable, and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.
